Arbitration & Mediation FAQ

SchedulingWe can be contacted by telephone or email to check on availability of dates and times for arbitration and mediation. Arbitrations are set based upon the specific requirements as determined by the parties and our office. Mediations are set for half day or full day sessions.

FeesPlease inquire as to the current hourly rate charged for arbitration/mediation services. The non-refundable retainer is 3 hours per session. Each party is required to pay a deposit in advance. The remaining balance is due at the conclusion of the session.

Platform & VenueCurrent sessions can be held in person or via Zoom. The protocol is “shuttle” diplomacy interaction during the meeting in break out rooms with each set of parties and their respective attorneys. If there are special circumstances, such as outstanding Orders, please advise our office at least 48 hours in advance to determine if any other additional considerations are required. For in-person sessions, arrangements should also be made 48 hours in advance. In those instances, a travel time will also be incurred in addition to the stipulated fee.

AgreementsArbitration awards will be filed in the respective court, and are subject to approval by the court of jurisdiction. In mediation, this office will make every effort to achieve a settlement for the parties. When the parties agree, the settlement: (Civil Rule 2A) agreement shall be binding on all parties, and subject to approval by the respective court.

CancellationsCancellation or postponement 10 days or less prior to the scheduled mediation shall result in the forfeit of the retainer. The session date can be postponed and rescheduled with proper notice to all parties.

Documentation & materialsAny settlement documentation or materials must be provided at least 3 business days before the session to ensure that we have the opportunity to thoroughly review the documents. Materials can be sent electronically in a secure format, or hard copies can be sent to the address listed on the website.
